Using data from a randomized field experiment within a Deliberative Poll, this paper examines deliberation’s effects on both policy attitudes and the extent to which ordinal rankings of policy options approach single-peakedness (a help in avoiding cyclical majorities). The setting was New Haven, Connecticut, and its surrounding towns; the issues were airport expansion and revenue sharing – the former highly salient, the latter not at all. Half the participants deliberated revenue sharing, then the airport; the other half the reverse. This (...) split-half design helps distinguish the effects of the formal on-site deliberations from those of other aspects of the treatment. As expected, the highly salient airport issue saw only a slight effect, while much less salient revenue-sharing issue saw a much larger one. (shrink)

The existing literature on the relationship between organizational commitment and ethical decision making suggests that ethical decision makers with higher organizational commitment are less likely to engage in ethically questionable behaviors. The ethical behaviors previously studied in an organizational commitment context have been organization-harm issues in which the organization was harmed and the individual benefited (e.g., overstating an expense report). There is another class of ethical issues in an organizational context, however. These other issues, termed organization-gain issues, focus on the (...) organization obtaining a benefit while outsiders, such as investors, are harmed (e.g., overstating reported revenue). We explore whether individuals with higher organizational commitment are more or less likely to engage in questionable behaviors that benefit the organization. Results of our study indicate that individuals with higher organizational commitment are less likely to engage in ethically questionable behaviors, regardless of whether the behaviors are organization-harm or organizational-gain issues. ExcerptDavid Graeber and David Wengrow, The Dawn of Everything: A New History of Humanity. New York: Farrar, Straus and Giroux, 2021. Pp. 704. The Dawn of Everything is not just a massive book in terms of its total number of pages but also in the amount of archaeological evidence discussed concerning human “prehistory.” The authors range over current disputes within their disciplines as well as discussing in some detail political philosophies of the seventeenth and eighteenth centuries. In spite of (...) its size and range, the book has been widely reviewed and has had a publication success rarely seen with academic works. Attention to it may be in part due to the publishing career of its co-author David Graeber, who tragically died in 2020 just before the book appeared in print. The reason I mention this point is that Graeber’s work had both an academic and non-academic audience, in such books as Bullshit Jobs: A Theory, Debt: The First 5,000 Years, and The Democracy Project: A History, a Crisis, a Movement. He also had a public profile during the Occupy Wall Street movement beginning in 2011, which highlighted his advocacy of anarchism. Graeber’s political philosophy plays a significant role in this book. (shrink)

Flannery O'Connor is considered one of America's greatest fiction writers. The immensely talented Robert Giroux, editor-in-chief of Harcourt, Brace & Company and later of Farrar, Straus & Giroux, was her devoted friend and admirer. He edited her three books published during her lifetime, plus Everything that Rises Must Converge, which she completed just before she died in 1964 at the age of thirty-nine, the posthumous The Complete Stories of Flannery O'Connor, and the subsequent award-winning collection of her letters (...) titled The Habit of Being. When poet Robert Lowell first introduced O'Connor to Giroux in March 1949, she could not have imagined the impact that meeting would have on her life or on the landscape of postwar American literature. Flannery O'Connor and Robert Giroux: A Publishing Partnership sheds new light on an area of Flannery O?Connor?s life?her relationship with her editors?that has not been well documented or narrated by critics and biographers. Impressively researched and rich in biographical details, this book chronicles Giroux?s and O?Connor?s personal and professional relationship, not omitting their circle of friends and fellow writers, including Robert Lowell, Caroline Gordon, Sally and Robert Fitzgerald, Allen Tate, Thomas Merton, and Robert Penn Warren. As Patrick Samway explains, Giroux guided O'Connor to become an internationally acclaimed writer of fiction and nonfiction, especially during the years when she suffered from lupus at her home in Milledgeville, Georgia, a disease that eventually proved fatal. Excerpts from their correspondence, some of which are published here for the first time, reveal how much of Giroux's work as editor was accomplished through his letters to Milledgeville. They are gracious, discerning, and appreciative, just when they needed to be. In Father Samway's portrait of O'Connor as an extraordinarily dedicated writer and businesswoman, she emerges as savvy, pragmatic, focused, and determined. This engrossing account of O'Connor's publishing history will interest, in addition to O'Connor's fans, all readers and students of American literature. (shrink)

In this article, I take up two arguments in favor of the discursive model of legal argumentation: the claim to correctness argument and the dual nature thesis. The argument of correctness implies the dual nature thesis, and the dual nature thesis implies a nonpositivistic concept of law. The nonpositivistic concept of law comprises five ideas. One of them is the special case thesis. The special case thesis says that positivistic elements, that is, statutes, precedents, and prevailing doctrines, are necessary for (...) law in order to achieve legal certainty. Without this, law would not be as perfect as it could possibly be. But it says, at the same time, that this alone would not be enough to fulfill the claim to correctness. The claim to correctness refers not only to the real dimension of law, defined by statutes, precedents, and prevailing doctrines, but also to its ideal dimension, defined, first and foremost, by justice. The special case thesis is my oldest thesis. It has remained an essential element of my system over the years. Its connection with four other theses—the Radbruch formula, the human rights thesis, the idea of deliberative democracy, and principles theory—does not change this at all. On the contrary, this connection has lent greater strength to the special case thesis. (shrink)

These are the answers I gave to Brian Bix, Peter Koller, Ralf Posher, Torben Spaak, Timothy Endicott, and Jan Sieckmann at the end of a splendid conference day in 2018. The critique given to me concerned important aspects of three main themes in my work: the claim to correctness, human and constitutional rights, and the ideal dimension of law. Cette section comprend en elle la reproduction d’un débat oral qui avait eu lieu sur France culture entre Claude Lefort, Alain Finkielkraut et Robert Legros. La troisième partie porte sur l’expérience phénoménologique d’autrui. Elle montre que cette expérience prolonge et renouvelle d’une part la conception kantienne de l’expérience du proprement humain, et d’autre part la conception tocquevillienne de l’expérience du semblable. These three impressive volumes seem likely to be for some time the standard collection of Leibniz’s writings in Italian translation. Replacing two volumes of 1967-68, with the same title and publisher, which were edited by Domenico Omero Bianca, the new translation by Massimo Mugnai and Enrico Pasini offers the Italian reader an outstandingly comprehensive selection of Leibniz’s works in a presentation richly though unobtrusively illuminated by the latest scholarship. My chief aim in this review will be to give scholars working (...) in English an idea of the lines of study suggested by this new product of Italian scholarship, and the resources available in it. Leibniz's version of the ontological argument, a modal argument for theism on which he worked most intensively in the 1670s, has two stages. The first, an “incomplete” proof, concludes that God can only be a necessary being, and therefore if God's existence is possible, then God exists. The second stage is an a priori argument that the existence of such a necessary God is indeed possible. Leibniz's fullest attempts at a possibility proof turn on his conception of a most perfect (...) being, and the chapter concludes that they are not likely to succeed, in part because of difficulties in connecting the concepts of perfection and necessary existence. My aim in this article is to flesh out a new distinction between moral responsibility, as it is understood in light of Strawson’s “reactive attitudes,” and an institutional form of responsibility—a responsibility that employees bear for their work to their superiors. I show that Strawson’s view of responsibility is separate from organizational responsibility, and hence the responsibility of employees to their managers cannot be understood in terms of indignation or resentment, both of which are key Strawsonian concepts. The latter type (...) of responsibility can be understood in terms of objective attitudes, managerial demands, organizational standards, and related expectations. Based on a Cartesian and a Wittgensteinian notions of asymmetry between first- and third-person uses of psychological concepts, Strawson developed a view of responsibility that dissolves the above asymmetry. In contrast with the latter asymmetry, which focuses on those who ascribe psychological concepts to themselves and to others, Strawson’s view is centered on the recipients of reactive attitudes. According to his view, resentment and indignation differ because they are aimed at different recipients, something that cannot be applied in cases of organizational responsibility. (shrink)

Cet ouvrage est consacré à la refondation richirienne de la phénoménologie, à partir du traitement de la question de l'espace/temps phénoménologique archaïque. Par le biais de l'analyse de cette interrogation spatio-temporelle spécifique et de la pertinence qu'elle développe, l'objectif est double : d'une part, arriver à dégager un lieu de compréhensibilité, inédit, commun aux multiples enjeux les plus fondamentaux de la refonte et de la refondation de la phénoménologie transcendantale entreprises par Richir et, d'autre part, dans la foulée, permettre par (...) là même la possibilité de comprendre l'ensemble des textes du corpus. Cette compréhensibilité des mobiles philosophiques les plus importants de la phénoménologie refondue jointe à la possibilité d'une compréhension globale et transversale de la textualité richirienne doit permettre en outre de réfléchir et de fonder la démarche tout entière. En accomplissant cette refondation de manière tout à fait originale, dans une oeuvre commencée en 1968 qui compte en 2012 près de dix mille pages, réparties en vingt ouvrages et près de deux cents articles, Richir poursuit le but et a comme ambition de bouleverser et de changer en profondeur les paramètres essentiels de la phénoménologie. Et, chemin faisant, la philosophie tout entière est à reprendre à nouveaux frais. Le lecteur est convié à pénétrer au coeur de ce nouvel espace/temps richirien, véritable idée directrice de la phénoménologie et d'une philosophie sans précédent. (shrink)
